Activity Waiver and Release

This Activity Waiver and Release ("Waiver") applies to surf sessions, lessons, coaching, guiding, meetups, board use, equipment rentals, ocean activities, and related activities that are discovered, requested, coordinated, or arranged through the Venture Sessions app, website, or related services (collectively, the "Platform").

Please read this Waiver carefully. By using the Platform to arrange, request, host, attend, or participate in any activity, you acknowledge and accept the risks described below.

1. Acknowledgement of Risk

Surfing and related ocean activities are inherently risky. Conditions can change quickly, and serious injury or death can occur even when participants, coaches, guides, or businesses act carefully.

Risks include, but are not limited to:

• Drowning, near-drowning, and water inhalation.
• Collision with surfboards, other surfers, swimmers, vessels, the ocean floor, reefs, rocks, piers, or other objects.
• Strong currents, rip currents, waves, shorebreak, large surf, shallow water, changing tides, and sudden changes in weather or ocean conditions.
• Cuts, lacerations, fractures, sprains, head injury, neck injury, spinal injury, paralysis, and death.
• Exposure to sun, cold, dehydration, and marine wildlife.
• Equipment failure, improper equipment use, or equipment that is not suitable for your ability, size, or conditions.
• Limited visibility, remote locations, delayed rescue, limited lifeguard coverage, or lack of immediate medical care.
• Negligent, reckless, or intentional acts or omissions by other participants, users, coaches, guides, businesses, or third parties.

You understand that these risks cannot be fully eliminated.

2. Your Responsibility

You are responsible for deciding whether to participate in any activity. You agree that you will use your own judgment before entering the water, attending a session, using equipment, meeting another user, or participating in any activity arranged through the Platform.

You represent that:

• You are physically and mentally capable of participating in the activity you choose.
• You can swim and are comfortable in the conditions you choose to enter.
• You will not participate while impaired by alcohol, drugs, illness, exhaustion, or any condition that could affect your safety or judgment.
• You will inspect and use equipment responsibly.
• You will follow applicable laws, posted warnings, lifeguard instructions, local rules, and reasonable safety guidance.
• You will stop participating if conditions, equipment, your health, or your comfort level make participation unsafe.

If you are accepting this Waiver for a minor, you represent that you are the minor's parent or legal guardian and that you accept these terms on the minor's behalf to the maximum extent permitted by law.

3. Role of Venture Sessions

Venture Sessions Incorporated ("Venture Sessions") operates the Platform and facilitates connections between surfers, coaches, guides, businesses, board owners, and other users.

Venture Sessions does not:

• Provide instruction, supervision, or in-water support directly.
• Employ, supervise, direct, or control coaches, guides, instructors, businesses, board owners, or other users.
• Verify, certify, insure, or guarantee the qualifications, credentials, conduct, equipment, or safety practices of any user.
• Inspect, certify, maintain, or guarantee any board, equipment, location, condition, listing, session, or activity.
• Control ocean, surf, weather, crowd, location, traffic, wildlife, or safety conditions.
• Provide emergency, rescue, medical, transportation, insurance, or lifeguard services.

Activities are arranged and conducted by independent users or third parties. Venture Sessions is not a party to any activity unless expressly stated otherwise in writing.

4. Assumption of Risk

To the maximum extent permitted by law, you knowingly and voluntarily assume all risks associated with activities arranged, discovered, requested, or coordinated through the Platform, whether known or unknown, foreseeable or unforeseeable.

This includes risks arising from your own actions or omissions, the actions or omissions of other users or third parties, ocean and weather conditions, equipment, locations, transportation, and any activity before, during, or after a session or meetup.

5. Release and Waiver of Claims

To the maximum extent permitted by law, you release and discharge Venture Sessions and its officers, directors, employees, contractors, affiliates, agents, successors, and assigns from any and all claims, demands, damages, losses, liabilities, costs, and expenses arising out of or related to:

• Your participation in any activity arranged, discovered, requested, or coordinated through the Platform.
• Your use of any board, equipment, location, session, listing, or service connected to the Platform.
• Your interactions with coaches, guides, businesses, board owners, other users, or third parties.
• Injury, illness, death, property damage, emotional distress, economic loss, or other harm connected to any activity.

This release includes claims based on ordinary negligence to the maximum extent permitted by law. It does not apply to claims that cannot be released under applicable law, including where applicable claims involving gross negligence, willful misconduct, or statutory rights that cannot be waived.

6. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Venture Sessions and its officers, directors, employees, contractors, affiliates, and agents from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:

• Your participation in any activity.
• Your actions or omissions before, during, or after an activity.
• Your use, rental, sale, purchase, or handling of any board or equipment.
• Your violation of this Waiver, the Terms of Service, the Community Guidelines, or applicable law.
• Any claim brought by another person arising from your conduct or participation.

7. Medical Authorization

In the event of injury, illness, or medical emergency during an activity, you authorize qualified personnel, emergency responders, medical providers, coaches, guides, businesses, or other available persons to seek or provide first aid, rescue, transportation, or emergency medical treatment as reasonably necessary.

You are responsible for all medical, rescue, evacuation, transportation, and related costs.

8. Insurance

Venture Sessions does not provide accident, health, medical, disability, property, equipment, travel, rescue, or liability insurance for participants, coaches, guides, businesses, board owners, or other users.

You are responsible for deciding whether you need insurance and for obtaining any coverage appropriate for your activities.

9. Third-Party and Provider Waivers

Coaches, guides, businesses, board owners, event hosts, or other third parties may require their own waivers, releases, policies, or agreements. Those documents are separate from this Waiver.

You are responsible for reviewing and deciding whether to accept any third-party or provider-specific terms before participating.

10. Acknowledgement

By using the Platform to arrange, request, host, attend, or participate in an activity, you confirm that you have read this Waiver, understand it, and accept it voluntarily.

If any part of this Waiver is found unenforceable, the remaining parts will continue to apply to the maximum extent permitted by law.
